Expert Answer

A social media policy sets out the rules and expectations for how employees use social media — both during work hours and personally where it could affect the business. In the age of viral posts, having a clear policy is essential.

Key Elements

1. Scope

Define what the policy covers: all social media platforms (Facebook, X/Twitter, LinkedIn, Instagram, TikTok, etc.), and whether it applies to personal and/or professional use.

2. Acceptable Use During Work

  • Whether personal social media use is permitted during work hours
  • Rules for using company devices for personal social media
  • Guidelines for employees who manage company social media accounts

3. Personal Use Guidelines

  • Employees must not post content that could damage the company's reputation
  • Confidential business information must never be shared on social media
  • Employees should not claim to speak on behalf of the company without authorisation
  • Posts that could constitute harassment, discrimination, or bullying of colleagues are prohibited

4. Confidentiality and Data Protection

  • No sharing of trade secrets, client information, or internal communications
  • No posting photos or videos from the workplace without permission
  • Compliance with GDPR when sharing any personal data

5. Consequences

Set out clearly that breaches may lead to disciplinary action, up to and including dismissal for serious breaches (e.g., sharing confidential information or posting discriminatory content).

6. Monitoring

If the employer monitors social media use, this must be clearly stated and comply with data protection law.
