An equal opportunities policy is a formal statement of your organisation's commitment to treating all employees, job applicants, and other stakeholders fairly and without discrimination. While not strictly a legal requirement, it is strongly recommended and can provide significant legal protection.
Why Have One?
- Vicarious liability defence — under the Equality Act 2010, employers are liable for discrimination by their employees unless they can show they took "all reasonable steps" to prevent it. Having and enforcing an equal opportunities policy is a key part of this defence
- Legal compliance — demonstrates compliance with the Equality Act 2010
- Public sector requirement — public sector employers have a specific Public Sector Equality Duty that an equal opportunities policy helps fulfil
- Tender requirements — many public and private sector contracts require suppliers to have an equal opportunities policy
- Recruitment and retention — demonstrates to candidates and employees that you value fairness and inclusion
What Should It Cover?
- Statement of commitment — a clear declaration that the organisation is committed to equality of opportunity
- Scope — all aspects of employment: recruitment, training, promotion, pay, benefits, and termination
- Protected characteristics — reference to all nine characteristics under the Equality Act
- Types of discrimination covered — direct, indirect, harassment, and victimisation
- Responsibilities — who is responsible at each level (senior management, line managers, all employees)
- Recruitment commitments — fair selection based on merit, accessible application processes
- Reasonable adjustments — commitment to making adjustments for disabled employees and applicants
- Complaints procedure — how to report a breach of the policy (linked to your grievance procedure)
- Training — commitment to equality and diversity training for all staff
- Monitoring and review — how the policy will be monitored and how often it will be reviewed
